SARDI LAW is proud to announce that Carlos E. Sardi has been named Chair of the Judicial Liaison Committee of the Business Law Section of The Florida Bar. The Committee provides a forum for informal communication and the sharing of ideas and/or complaints among the bar and the bench, and is uniquely situated to advance ideas to improve bankruptcy law, procedures and practice in Florida’s three Federal Districts. The Committee also works toward the adoption of uniform rules and procedures throughout the state’s bankruptcy courts.

Carlos E. Sardi Named Chair of the Bankruptcy/UCC Committee of the Business Law Section of The Florida Bar
SARDI LAW is proud to announce that Carlos E. Sardi has been named Chair of the Bankruptcy/UCC Committee of the Business Law Section of The Florida Bar. The Bankruptcy/UCC Committee consists of lawyers who practice commercial law and specialize in bankruptcy, creditors rights, and secured transactions. The Committee drafts and analyzes proposed legislation concerning the Uniform Commercial Code, as well as legislation that affects other rights of secured creditors under state law, such as the statues governing foreclosure, assignment of rents, and exemptions. The Committee sponsors various seminars, including the annual View from the Florida Bankruptcy Bench, at which the Bankruptcy Judges share their respective views concerning bankruptcy law and procedure. The Committee also studies the interplay between the federal Bankruptcy Code and state laws governing exemptions and creditors rights.

Carlos E. Sardi Interviewed by The Miami Herald about Sale of Home of Dade Medical College's Principal
Carlos Sardi explains that Ernesto Perez’s $2 million home is largely exempt from any claims by employees or students since Florida law protects homesteaded from such claims. Should the home sell, however, the sale proceeds would be protected so long as they are reinvested in their entirety in another homestead property. In addition, the property may be also exempted from creditors' claims as the same appears to be in the name of both husband and wife - which creditors of only one spouse would not be able to attack.

Creditors, including students, need to seek the help of counsel to adequately protect their interest in this type of state law insolvency proceeding known as "assignment for the benefit of creditors," which is similar to a liquidation in bankruptcy. Closure of Dade Medical College has left over 2,000 students owing massive amounts of student loans, leaving enrolled students with the limited optioin of having their federal loans forgiven at the expense of having to start all over or enroll in another school willing to take their credits.
